By accessing or using Apex AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Sparke Data Solutions ("we," "our," or "us") reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

Apex AI allows users to upload screenshots or photographs of trading charts and receive AI-generated trade ideas and analysis. Users may optionally save these ideas to their History for future reference.

3. No Financial Advice

Apex AI is for informational and educational purposes only. The trade ideas, analysis, and suggestions provided by the Service do not constitute financial, investment, legal, or tax advice.

  • You should consult a licensed financial advisor before making any trading or investment decisions.
  • Past performance and AI-generated ideas do not guarantee future results.
  • Trading involves substantial risk of loss, and you may lose all invested capital.
  • We are not responsible for any financial losses you incur based on information from Apex AI.

4. User Responsibilities

By using Apex AI, you agree to:

  • Provide accurate information and use the Service in compliance with all applicable laws.
  • Not upload illegal, harmful, or infringing content.
  • Not attempt to reverse-engineer, hack, or disrupt the Service.
  • Not use the Service for any automated, bulk, or commercial scraping without permission.
  • Accept full responsibility for your trading decisions and outcomes.

5. Intellectual Property

All content, features, and functionality of Apex AI (including but not limited to text, graphics, logos, software, and AI models) are owned by Sparke Data Solutions or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of the chart images you upload. By uploading, you grant us a limited license to process and analyze those images to provide the Service.

6. Limitation of Liability

To the fullest extent permitted by law:

  • Apex AI is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
  • We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the Service, including financial losses from trading decisions.
  • In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability is limited to the maximum extent permitted by law.

7. Indemnification

You agree to indemnify, defend, and hold harmless Sparke Data Solutions, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

8. Privacy

Your use of Apex AI is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

9. Termination

We reserve the right to suspend or terminate your access to Apex AI at any time, with or without cause or notice, including for violation of these Terms. You may stop using the Service at any time.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Sparke Data Solutions operates, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the appropriate courts of that jurisdiction.

11. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
